This Privacy Policy is issued by TVU Networks Corporation, including its subsidiaries and affiliated companies (referred to in this document as “we” or “us”).

This privacy policy explains how we collect, use, and share your personal information when you use our website and our products and services.   We respect the privacy of every individual and are committed to protecting it in compliance with all applicable laws and regulations.  Your consent to this privacy policy is required in order to use our website and our products and services.

 

1. What information do we collect?

We collect personal information that you provide to us when you register on our website, place an order, subscribe to one of our cloud-based software services, request a quote, visit our booth at a trade show, contact us, or otherwise interact with us. The types of personal information we collect depends on the products and/or services you use, and it may include:

  • Name, email address, phone number, business or company name (if applicable), and other contact details that form part of our customer records
  • Billing and shipping addresses
  • Order history
  • Geolocation data, which is recorded by cookies in order to set the relevant language for your location (see section 9 below)
  • Information scanned from badges of individuals who visit our booth at a trade show
  • Preferences, feedback, comments, questions, and other information you voluntarily provide to us

 

We also collect certain information by automated means when you visit our website or use our cloud-based software services, for example:

  • Your IP address, browser type, device type, operating system, and other technical information.
  • Your browsing activity, such as the web pages within our site that you visit, the links you click, the time and duration of your visit, and other statistics.
  • Cookies and similar technologies that help us recognize that you have visited our website or used our services in the past, customize your experience, and improve our website; we require you to specify your cookie preferences when you visit our website, and we honor those preferences.

 

We do not ask for, collect, or process any sensitive personal information such as biometric information, religious beliefs, race or ethnicity, genetic data, sex information, political opinions, union membership, medical or health information, financial information, any personal identifying information (e.g., driver’s license or social security number), and your account log-in credentials (other than the email address you use to log in to our services). 

We use automated decision-making technologies to support some of our data processing activities, for example in displaying the website in a language that is used in the location where you are located.  We use Artificial Intelligence (“AI”) technology in connection with some TVU Solutions (notably TVU Search), and also to assist us in providing customer support via a chatbot.  However, we do not use AI to process any of your personal information, and we commit that none of your personal information will be exposed to any AI tool where it could potentially be incorporated into the AI knowledge base or used in the training of any AI model.

2. What about video content you create using our products and services?

When you use TVU hardware equipment or cloud-based software services to create video content, any personal information included in that content is not visible to us, even though it passes through our infrastructure which is technically defined as “processing”.  Our service is analogous to a plumbing system where we provide the “pipes” (hardware and software platform), and you create the “liquid” (video content) that runs through them.  Any personal information that is included in your content is protected by our security framework and best practices, as described in section 7 below.

3. How do we use your information?

We use your personal information for various purposes, such as:

  • To provide you with our products and services, process your orders, provide support to you, communicate with you, and fulfill our contract obligations to you.
  • To notify you of updates to any of our products and services you acquired or are using;
  • To improve our website, products, and services, conduct market research, analyze customer behavior, and measure performance.
  • To send you marketing communications, newsletters, offers, promotions, and other information that may interest you, but only if you have “opted in” to receive these communications.
  • To protect our rights and interests, prevent fraud and abuse, comply with legal and regulatory requirements, and respond to lawful requests from authorities.
  • To identify your location and provide access to the website in the relevant language.

4. How do we share your information?

We do not sell or rent your personal information to third parties. We may share your personal information with:

  • Our affiliates, business partners and service providers, who need the information in order to perform important functions or components for the equipment or software you use, such as hosting, payment processing, shipping products, and conducting analytics, marketing, and customer support; we require these third parties to agree to treat your information in confidence and to use it only in performing services or providing components to us.   
  • Other parties with your consent or as instructed by you, such as when you share your information through social media platforms or third-party applications.

 

We may disclose your personal information if we are required to do so by law or in response to a subpoena, a court order, a regulatory audit, or request from a government official).   We may also disclose your personal information if we consider that it is necessary to:

  • enforce our Terms of Service or our legal rights;
  • protect our confidential information or our property; and
  • protect the rights of any of our users or third parties.  

 

We may disclose or otherwise process your personal information if it becomes essential in the event of any merger, acquisition, sale or transaction involving all or a portion of our business.  

In all of the above cases, we will disclose only such information as is necessary under the circumstances, and we will take precautions to maintain the confidentiality of the information to the maximum extent possible.

5. What is the legal basis for the information we collect and use?

Some of the information we collect and use consists of “personal data” or “personal information,” which is defined in slightly different ways depending on which data protection laws you consult.  Essentially, personal information consists of any information about a living person that identifies or could be used to identify that person.  More precise definitions are given in 

  • The European General Data Protection Regulation (GDPR):  “Any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”; and
  • The California Consumer Privacy Act (CCPA): “Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.”  

 

We process your personal information as necessary to enable us to conduct our business, including to:

  • perform our contractual obligations to you;  
  • provide the website in your local language if applicable;  
  • provide you with customer support;  
  • notify you of technical product and/or service updates; and
  • conduct marketing and promotions based on your consent.

 

The individuals or groups who may need to access and use your personal information include:

  • business partners and suppliers who need the information to help us provide products and/or services to you;  and 
  • individuals in TVU’s senior management, Human Resources, Finance, and technical groups who require the information in order to perform their responsibilities.  

 

Some of these individuals, partners and suppliers are located outside of the European Union, including in countries that may not provide the same level of data protection as your home country.   We take appropriate steps to ensure that such individuals and suppliers comply with applicable data protection laws and regulations and that your personal information is protected and secure. 

If we need to process your personal information pursuant to applicable law, or to provide products and/or services to you, and you fail to provide the necessary information when requested, we may not be able to perform as required.  We may not be able to provide the product(s) and/or service(s) to you.  

If you provide us with personal information of other individuals (e.g., a friend, a relative, or a co-worker), it is your responsibility to ensure that you have the person’s consent or other legal basis to provide it to us.

6. What are your rights?

Depending on where you are located and subject to applicable laws and regulations, you have certain rights regarding your personal information. These rights may include:

  • The right to access your personal information that we hold about you and request a copy of it.
  • The right to correct or update any of your personal information that is inaccurate or incomplete.
  • The right to delete or erase your personal information that we no longer need or have a legal basis to keep.
  • The right to restrict or limit the processing of your personal information in certain circumstances.
  • The right to object to the processing of your personal information for direct marketing purposes or for other purposes based on our legitimate interests.
  • The right to withdraw your consent at any time for any processing of your personal information that is based on your previous consent.
  • The right to lodge a complaint with a supervisory authority if you believe that we have violated your privacy rights.

7. How do we protect your information?

We take necessary technical and organizational measures to protect your personal information from unauthorized access or use, interference, misuse, disclosure, alteration, destruction, and loss. These measures include:

  • Use of encryption and other security best practices to safeguard your personal information during transmission and storage.
  • Implementing access controls and policies that limit who can access your personal information, and for what purposes.
  • Conducting periodic testing, reviews and audits to monitor and evaluate the effectiveness of our security measures.

 

However, note that no matter what or how many security measures we implement, no method of transmission or storage is 100% secure, and we cannot guarantee the absolute security of your personal information. You are responsible for maintaining the confidentiality of your account credentials and notifying us immediately if you suspect any unauthorized activity on your account.

8. How long do we keep your information?

We retain your personal information for as long as necessary to fulfill the purposes for which we collected it, unless a longer retention period is required or permitted by law. The retention period may vary depending on the nature and scope of our relationship with you, the type and category of your personal information, and our legal and regulatory obligations. When we no longer need your personal information, we will securely delete or anonymize it in accordance with our data retention policy and applicable laws and regulations.

9. How do we use cookies and similar technologies?

Cookies are small text files that are stored on your browser or device when you visit our website. They help us recognize you, remember your preferences, customize your experience, and improve our website. We may also use other similar technologies, such as web beacons, pixels, tags, scripts, or local storage, to collect and analyze information about your online activity.

Cookies and similar technologies do not necessarily identify you as a person;  they may simply identify your IP address or some other characteristics of the device you use to connect with our website or our services.

We use both first-party and third-party cookies on our website. First-party cookies are set by us or our service providers and allow us to operate our website and provide you with our products and services. Third-party cookies are set by other parties that are not under our control and may be used for advertising, analytics, or social media purposes.

We use a cookie banner on our website where you can manage your cookie preferences.  You can choose to accept, or decline, all cookies, and you can change your preference at any time using the link to “cookie settings” in the footer of every page of the website. 

Please note that disabling or blocking cookies may affect the functionality and performance of our website, and some features may not work properly or as intended.

10. How do we handle third-party links?

Some of our services interface by means of Application Programming Interfaces (“APIs”) with website content and services maintained by third parties that we do not control (e.g., business partners and other service providers).  This Privacy Policy does not cover the actions of these third parties.  If you link to any third-party website and/or services from any TVU Solution,  you should read the applicable privacy policy since your interaction will be subject to that third party’s privacy policies.  In particular, TVU has APIs that link with YouTube and Google.   By interfacing with these websites and services, you are agreeing to comply with YouTube Terms of Service and the Google Privacy Policy:

11. How do we handle children’s privacy?

Our website is not intended for individuals under the age of 16, and we do not knowingly collect personal information from children under 16. If we are notified or otherwise become aware that we have collected personal information from a child under 16, we will delete it as soon as possible. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us at privacy@tvunetworks.com.

12. How do we update our privacy policy?

We may update our privacy policy from time to time to reflect changes in our practices, new technologies, or changes in applicable laws or regulations.   If we make changes, you will be asked for your continued consent the next time you access our website in the same manner as you were asked to consent when you first accessed our site.  The date at the top of this privacy policy indicates when it was last updated.
